This policy applies to your use of thenateshow.com web site and any interactive features, downloads or widgets made available through the web site or that interact with the web site and include a link to this policy (collectively, the "Site"), whether accessed via computer, mobile device or other technology. The Site is owned and operated jointly by Sony Pictures Television Inc. (“Sony”) and Harpo Productions, Inc. (“Harpo”)  (collectively, "we," "us" or "our")  and any information collected by the Site is collected, used and owned jointly by both Sony and Harpo, both of whom will use it in accordance with this privacy policy.  This policy does not apply to your use of other web sites (including those to which the Site links) nor does it apply to information collected offline by us (unless specifically stated). 

This privacy policy will advise you about our collection and use of your personal information including the reasonable efforts we make to protect your personal information in accord with this policy, and the choices you have concerning our use of such information. Please read this policy carefully. We may need to change this policy from time to time in order to address new issues and reflect changes on our sites. We will post those changes here, which will become effective immediately upon posting, so that you will know our policies regarding what information we gather, how we might use that information and under what circumstances we disclose that information to third parties. However, we will use your personal information in a manner consistent with the policy in effect at the time you submitted the information, unless you consent to the new or revised policy. 1.  Personal Information
We may request "Personal Information" from you, which is information that could be used to contact you or identify you personally (such as your name, street address, telephone number or e-mail address) in connection with your use of, or participation in, membership registration for thenateshow.com, our contests, sweepstakes, promotions, games, surveys, forums, subscription registrations, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, visitors' requests for free products or services or additional information (including via e-mail to us) and in connection with other activities, services or resources we make available on our Site. The Site may also ask you to provide other information about yourself, such as demographic information (gender, ZIP code, etc.) or certain information about your preferences and interests.  If we combine demographic or other information we collect about you with personal information about you, we will treat the combined information as personal information

We may use personal information and  any non-personal information (including Usage Information) collected through the site to: (1) conduct the feature or activity in connection with which you provided your information; (2) provide you with information or services that you have requested or agreed to receive; (3) process your registration on the Site, including verifying your e-mail address is active and valid; (4) tailor content, advertisements, and offers we serve you; (5) improve the Site and for internal business purposes; (6) contact you with regard to your use of the Site and, in our discretion, changes to the Site policies; and (7) for purposes disclosed to you at the time you provide your personal information or otherwise with your consent.

Please note that information submitted to the Site via a "contact us” or other similar function may not receive a response. We will not use the information provided to contact you for marketing purposes unrelated to your request unless you agree otherwise.

If you use the Site to send a friend an invitation to participate in the Site or send other Site-related communications, the information you provide (typically, names and e-mail addresses) is used on a one-time basis to facilitate the communication on your behalf, and is not used for any other marketing purposes unless we obtain consent from that person.

2.  Information We Receive From Third Parties
 We may receive information about you from various third parties. For example, if you are on another web site and you opt-in to receive information from our Site, that third party web site will forward to us your e-mail address and other information about you so that we may contact you as requested. You may also choose to participate in a third party application or feature (such as via Facebook or a similar application or feature via a third party web site) through which you allow us to collect (or the third party to share) information about you, including personal information. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected. In addition, we may receive information about you if other users of a third party web site give us access to their profiles and you are one of their "connections”  or information about you is otherwise accessible through your “connections’”  web page, profile page, or similar page on a social networking or other third party web site or interactive service.

We may also supplement the information we collect about you through the Site with outside records from third parties in order to enhance our ability to serve you, to tailor our content to you and to offer you opportunities to purchase products or services that we believe may be of interest to you. If we combine the information we receive from third parties with information we collect through the Site, we will treat it in accordance with this privacy policy.
  
3.  How We May Share The Information Collected Through the Site
 We may share non-personal information, such as aggregated user statistics, and Usage Information with third parties.
We may share your personal information as set forth in this policy and in the following circumstances:
  
a. When You Agree To Have Your Personal Information Shared.
We do not share your personal information with third parties for those third parties' marketing purposes unless you give us your permission.  While on our Site, you may have the opportunity to opt-in to receive information and/or marketing offers from someone else or to otherwise consent to the sharing of your information with third parties.  If you wish to opt-out from having your personal information shared with third parties on a going-forward basis, visit  www.thenateshow.com/profile on the Site and change your preferences.  Note, however, that once your information is shared, if you later wish to opt-out from marketing communications you receive from a third party, you will need to contact that third party directly. .   

b. Legal Protections and Law Enforcement.
We may transfer and disclose information, including your personal information, Usage Information and Device Identifier, (including IP address), to third parties to comply with any valid legal inquiry or process such as a search warrant, subpoena, statute or court order. We may also release specific information in special cases, such as if there is an attempted breach of the security of the Site or a physical or property threat to you or others. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers or law enforcement agencies, in our discretion. Such disclosures may be carried out without notice to you.
 

c. Business Transfers.
The Site may be sold, or other transactions may occur in which your personal information is one of the key business assets for the transaction. Therefore, we may also transfer user information, including personal identification information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division or other fundamental corporate change.
 

d. Third Parties Providing Services On Our Behalf. 
We may provide access to your personally identification information to our contractors who are performing services for us in connection with our Site or the services that you have requested.

e. Sweepstakes, Contests and Promotions.
In addition, on occasion, we may collect Personal Information from you in connection with optional contests, special offers or promotions (each, a "Promotion). We will share such information with necessary third parties for the purpose of carrying out the Promotion. Your participation in the Promotion constitutes your consent to such disclosure and use of such information. By entering a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor and/or other parties to use your name, voice and/or likeness in advertising or marketing materials.

4.  Information You Disclose Publicly On Our Site
The Site may offer message boards, chat rooms, blogs and other public areas (such as the "Share with Nate" feature) (collectively, “Forums”) where you can engage in social networking, interact with others, as well as have the opportunity to submit photographs, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or other content (collectively, "Submissions").  To participate in certain Forums, you may be asked to select a username, screen name or member name and password.  Please do not use your real name or the real name of another person when selecting a username (or screen name or member name).

Please note that when you post Submissions or you give out personal information on one of our  Forums, that information can be collected and used by third parties and we have no control over how such third parties may use your information. You disclose such information at your own risk.
Submissions may be published online or offline in any media or format (currently existing or hereafter developed).  We may also publish your name, voice, likeness and other personal information with your Submissions, and we may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities.  For full terms and conditions regarding Submissions you submit to the Site, please review our Terms of Use.


5.  Non-Personal Information
 When you visit or interact with the Site, or click on one of our advertisements or our content served on elsewhere on the internet, we and our third-party advertisers and/or service providers may use a variety of technologies that automatically or passively collect information about how the Site is accessed and used ("Usage Information").
 We collect Usage Information through the use of, without limitation, the following types of methodology:

Cookie technology:
A "cookie" is a data file that a website can send to your Device, which is then stored on your Device. A Flash cookie is data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. Cookies and Flash Cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to our web pages. If you choose to disable cookies or Flash cookies on your Device, some features of the Site may not function properly.

IP Address Tracking:
The Site also automatically collects your IP address or other unique identifier ("Device Identifier"), which is a number that is assigned to your computer, mobile device  or other device (collectively, “Device”) that you use to access the Site . When you request pages from our Site, our servers log your Device Identifier. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier.  Some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the Device used to access the Site.

Web Beacons:
A Web beacon, or "clear gif," is a small graphic image on a webpage or web programming code that may be included in the Site and Site e-mail messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to determine whether content sent was actually viewed.
 

Embedded Scripts.

An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your Device from our server or a third party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

Usage Information might include the browser you use, the type of computer you use and technical information about your means of connection to our Site, such as the operating systems and the Internet service providers utilized and other similar information. Our systems may also automatically gather information about the areas of the Site you visit and search terms you use on our Site and about the links you may select from within our Site to other areas of the Web or elsewhere online.

We use such information for our business purposes and to administer the Site, better manage advertising on the Site and, in the aggregate, to understand how our users as a group use the services and resources provided on our Site. This way, we know which areas of our Site are the favorites of our users, which areas need improvement and what technologies are being used so that we may continually improve our Site.  We may also share this Usage information with our partners, suppliers and other third parties, including third party advertising companies and web analytics providers, as described in the following section. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information.
 

6.  Ad Serving And Traffic Measurement Services We May Use
We license technology to serve advertisements on the Site as well as within Site widgets and Site content that may be served across the Internet (such as within Site videos). In addition, we may use third party network advertisers to serve advertisements and third party analytics service providers to evaluate and provide us with information about the use of the Site and viewing of our content.  We do not share personal information with these third parties, but ad network providers, the advertisers, the sponsors, and/or analytics service providers may set and access their own cookies, web beacons and embedded scripts on your Device and they may otherwise collect or have access to information about you, including Usage Information.
With regard to advertisements, we and our network advertisers may target advertisements for products and services in which you might be interested based on your visits to both the Site and other web sites. Cookies, web beacons and embedded scripts, including those set by third party network advertisers, may be used to, among other things, target advertisements, prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. We may share Usage Information about Site visitors with third party advertising companies for the same purposes.
We may use a variety of companies to serve advertisements. You may wish to visit http://www.networkadvertising.org/managing/opt_out.asp, which provides information regarding the "opt-out" procedures of certain third party ad servers we may use. In addition, we work with Live Rail, which offers a separate consumer opt-out. 
 

7.  You Must be 18 Years of Age
The Site is not directed to children under the age of 18 and we will not intentionally collect personal information from children under 18.

8.  Links to Other Sites; Site Content on Third Party Sites
Users will find advertising or other content on our Site that link to the site and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites. In addition, Site widgets or other Site content may be included on web pages and web sites that are not associated with us and over which we have no control. These sites and services may have their own privacy policies and customer service policies or no policy (policies) at all and may independently collect data, solicit personal information or collect Usage Information from your Device. We encourage you to review the privacy policies of any third-party sites or services before providing any of them with your personal information. We are not responsible for the privacy practices of any third party web site.
 

9.  Security
We have taken commercially reasonable measures to secure both your information and our physical premises. However, we cannot guarantee that our measures will completely bar unauthorized access to or disclosure of your information, and by using the Site you assume this risk.

10.  Access to/Correction of Information
If you wish to correct or update some of the personal information you have provided to us, log in to the Site and click on your user name at the top of the page to edit your profile  [link [www.thenateshow.com/profile] page of the Site to do so. If you would like to review any other personal information you believe we have retained about you in our database, please send us an e-mail request for this information at nb-webpolicy@thenateshow.com. To help us address your request, please specify which information you wish to review. Once you have reviewed this information, at your request, we will correct personal information about you that you state is erroneous. To request such a correction, please send an e-mail to nb-webpolicy@thenateshow.com. You should be aware, however, that it is not always possible to completely remove or modify information in our databases and servers, although we will always make reasonable efforts to do so upon your request. Please also understand that due to the volume of traffic on the Site and correspondence received, we cannot make any representations about the timeliness of the making of such modifications. In addition, we are unable to modify your information in the records of any third party who has been provided with your information in accordance with this policy.

 11.  Choice/Opt Out
If we offer you the opportunity to opt in to receive information from third parties, and you would like to opt out from future sharing of your personal information with third parties, log in to the Site and click on your user name at the top of the page to edit your profile log [link [www.thenateshow.com/profile]] page of the Site and change your preferences. Your profile page may offer the opportunity to update your preferences regarding the information you receive from us. You may also opt out of receiving e-mail newsletters or other marketing emails by following the opt-out instructions provided to you in those e-mails.  Please note that we reserve the right to send you certain communications relating to your account or use of the Site and these transactional account messages may be unaffected if you choose to opt-out from marketing e-mails.
In accordance with our routine record keeping, we may delete certain records that contain personal information you have submitted through the Site.  We are under no obligation to store such personal information indefinitely and disclaim any liability arising out of, or related to, the destruction of such personal information. 

12.  Consent to Transfer
The Site is operated in the United States. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to, processed in and stored the United States. By using our website, participating in any of our services and/or providing us with your information, you consent to the transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.
